Terms and Conditions of www.linkfast.me

1. Introduction
LinkFast is a link in bio tool designed to allow users to freely share their social media links and the important and relevant content for them on a public profile.

The purpose of the present Terms and Conditions is to regulate the provision and use of our services on our website www.linkfast.me (hereinafter referred to as "website", "application", "platform", "web application"), and our entire platform.

Hereinafter, the terms "We", "LinkFast", "Our" mentioned in all places in this document refer to the company: DATARIVER INTERNATIONAL LIMITED (Address: Portnaquin, Killashandra, CAVAN, Ireland, registered in Ireland under 761175 Reg. no.)

When we refer to "You", "User" or "Users" in this agreement, we specifically mean you, the user of the service, the visitor of the website.
By using our website, you expressly accept and consider binding upon yourself the following guidelines.

2. Changes
We continuously develop and change our services and website. At the same time, we reserve the right to change, expand, or withdraw provisions and features in this agreement or on the platform at any time without prior notice. However, using the platform after such modifications does not exempt the user from accepting them.

3. Registration
To register on the Platform, you must be a natural person who has reached the age of majority, which is at least 18 years old, or a legal entity (such as a company, organization, or brand). You must have the authority to act and use your registered account solely on your own behalf. By creating an account, you expressly accept and consider the present Terms and Conditions binding upon yourself.

You are responsible for all information provided in your account and for any responsibility related to your account.You must have authorization to use the account and the information provided therein, ensuring that only you use it. This is particularly important regarding personal data and media content.

You may not disclose your login credentials, such as your password and email address pair, to third parties (except in the case of a legal entity, where authorized personnel of the organization may use them). Furthermore, we remind you that the email address used during registration must be valid, and you cannot use the service until it is confirmed.

You may not use the account in a manner that, in our reasonable opinion, damages, defames, or negatively portrays the reputation of LinkFast, or violates the rights of others or applicable laws and regulations.

Beyond this, LinkFast does not assume responsibility for the accuracy of the information provided.

4. Username
To register on the Platform, you must be a natural person who has reached the age of majority, which is at least 18 years old, or a legal entity (such as a company, organization, or brand). You must have the authority to act and use your registered account solely on your own behalf. By creating an account, you expressly accept and consider the present Terms and Conditions binding upon yourself.

The user has the opportunity to freely choose their username if the username is still available. The username must not infringe upon the rights of others in any way, particularly trademarks, copyrights, or industrial rights. The username must not be offensive, vulgar, or impersonate another individual or brand.

The user expressly assumes responsibility for choosing the username and agrees that the username must not be misleading or in any way associated with LinkFast's documentation. It must not be misleadingly similar to a LinkFast subpage, implying that it is under our content or supervision.

If another user or natural/legal person reports that your username does not comply with the provisions of these Terms and Conditions, or if we discover this ourselves, we will investigate the matter. If necessary, we may regenerate your username without prior notice, and in more severe cases, we may suspend your account without prior notice.

Furthermore, LinkFast excludes all other liability regarding usernames.

5. Account plans
LinkFast offers users the opportunity to choose from various plans with numerous features. Additionally, LinkFast provides the option for a free but limited plan (this is the default after registration).

When selecting a paid plan and providing bank card details, LinkFast will charge the user's bank account with the specified amount. The user has the option to cancel the plan at any time in their account, after that when the period expires, we will no longer charge the bank card.

If the user does not cancel the plan and the subscription reaches the renewal date, we will automatically charge the bank account until cancellation.

LinkFast rejects refunds to the fullest extent permitted by law, but exceptions may be considered on a case-by-case basis.

6. Public content
Any content containing the username provided by the user during registration, which is publicly browsable and accessible on the internet, editable by the user, as well as any text, visual, media or url content containing it, is considered public content.

The user acknowledges that the Community Standards are an integral and indispensable part of these Terms and Conditions, specifically applicable to public content.

The user agrees that all public content is their property, whether it is text, media, or any other part of the content, or if it comes from a third party, the user assumes responsibility for having the necessary permissions.

Public content must not infringe upon the rights of other users, individuals, or organizations. It must be well-intentioned and comply with the Community Standards. If, for any reason, the user violates this, we will notify them (usually via email), and if the content is not modified, we will immediately remove it. Furthermore, in extreme cases, we reserve the right to remove it immediately without prior notice, but this does not entitle the user to a refund or any compensation.

The user expressly declares that they refrain from any harmful, misleading, or content that would tarnish the reputation of LinkFast.

When a user edits or creates public content, they simultaneously grant LinkFast a final and irrevocable permission to:

a) Use, publicly display, distribute, modify, and create other content from it.

b) Use the user's name, image, text, design elements, and any other personal attributes in the content on the Platform and in our marketing across all media (such as social channels and any other advertising).

This license is worldwide, royalty-free, and perpetual, meaning that LinkFast can use the user's content anywhere in the world without paying the user any fees for as long as it desires. The user agrees that they have all necessary rights related to third parties required for publishing the content on the Platform and that LinkFast owns this license.

We would like to draw the user's attention to the fact that the content they create will be publicly accessible and can be used and shared by others on the Platform and the internet. Please refrain from sharing personal information on the Platform that you do not wish the world to see. Never share personal identification numbers, passport details, or similar private information that could cause harm if it falls into the wrong hands. You may only share another person's personal data if you have their consent and have recorded it. LinkFast is not obliged to monitor the accuracy, reliability, or legality of your content, but may choose to do so. LinkFast reserves the right to modify, remove, or restrict access to content at any time in accordance with these Terms, or to apply sensitive content warnings to content deemed inappropriate for all audiences.

LinkFast is expressly committed to resolving issues in good faith, and neither LinkFast nor the user will initiate legal proceedings until we have worked together for at least one month to find a solution. Furthermore, LinkFast excludes all liability for public content.

7. User's responsibility
The user is responsible for the visitors to their profile, including those customers who purchase goods or services through the Platform—collectively referred to as "End Users." You bear sole responsibility for the End Users' interaction with your profile and content, as well as compliance with all applicable laws regarding transactions between you and the End Users conducted through the Platform.

8. Feedback and suggestions
We greatly appreciate the feedback, suggestions, and ideas from users. Some of these may be utilized and introduced as features if we decide to do so.

The user acknowledges that the ideas and suggestions shared by them become the property of LinkFast as soon as they are shared with LinkFast, and may be used by LinkFast as it sees fit. In exchange, the user does not expect any monetary or other compensation.

9. The website
As the owner of the Platform, LinkFast provides users with limited rights to use it for sharing content and interacting with other users' content. However, it's important to note that we are not responsible for the content, products, or services available through other users' profiles. All rights, including Intellectual Property Rights related to the Platform (excluding your content), are solely owned by LinkFast or our licensors. You may not acquire any rights in LinkFast, and its use, including our brand name or logo, for any purpose is not permitted without prior written approval, including implying that you have received partnership or endorsement from LinkFast.

As a user, LinkFast grants you limited, revocable, non-exclusive, and non-transferable rights to use the Platform for creating, displaying, using, playing, and uploading content in accordance with these Terms.

LinkFast may provide images, icons, themes, fonts, videos, graphics, or other content to users. Users may exclusively use these assets only on their own profiles and in accordance with the guidelines provided by us. Users may not remove, hide, or modify any proprietary marks or trademarks on the Platform. Copying, reproducing, distributing, licensing, selling, reselling, modifying, translating, dismantling, decompiling, encoding, deciphering, or attempting to extract the source code of the Platform or any part thereof is strictly prohibited. When you visit a profile on LinkFast as a "profile visitor," we grant you limited, non-exclusive, and non-transferable rights to view and interact with the Platform through user profiles. To the extent permitted by law, we are not responsible for opinions, advice, statements, products, services, offers, or other content posted by other users on their profiles.

10. Payments and fees
Subscription Fees:
If you have chosen a paid plan, please ensure that there are sufficient funds in your bank account and that your bank card or payment method is not expired. This is the user's responsibility. These fees are generally provided in USD and include transaction taxes such as VAT, unless otherwise specified. Subscription fees are billed and charged in advance on a recurring basis to the payment method you provided, depending on whether you chose a monthly or annual billing cycle. At the end of each billing cycle, the subscription plan automatically renews based on the updated Terms unless you decide to cancel. When registering, provide accurate billing information and a valid payment method (such as a credit card). This authorization allows us to charge the appropriate fees. In case of automatic billing failure, you will receive an online invoice that must be paid within the specified timeframe.

Processing Fees:
Transactions executed on the Platform are processed by external payment processing services, such as Stripe, which may incur processing fees. Each payment processor has its own fees and terms, which should be reviewed, accepted, and adhered to. Processing fees are deducted from transaction revenues before you receive them. It is important to note that LinkFast is not responsible for these specific fees.

Fee Changes and Prior Notice:
LinkFast reserves the right to modify subscription or transaction fees. If any changes occur, we will send prior notification, typically at least 30 days before the changes take effect. If a user does not accept the new fees, they have the option to cancel their plan before the start of the next billing cycle.

11. Data Protection
At LinkFast, ensuring data protection and the privacy of your Profile Visitors is of paramount importance. Our Privacy policy provides detailed information on how we handle personal data. The Terms determine your (and LinkFast's) obligations regarding the data protection rights of visitors to your profile. By creating an account, you confirm that if the Privacy Policy applies to you, you have read, understood, and agreed to it. For information regarding cookie usage, please refer to our Cookie policy.

All data, including any associated intellectual property rights generated by us or the Platform from your usage (or the usage of profile visitors or other users) of the Platform or content ("Data"), remains the property of LinkFast. As part of the services offered on the Platform, we may provide you with data or its visual representations, which we refer to as "Statistics." While we do not guarantee the accuracy or completeness of the Statistics, we strive to ensure they are as accurate and comprehensive as possible.

12. Liability
We want to clarify that we are not responsible for how you use the Platform, and it’s crucial that you maintain backups of your own content. We are not liable for any damages resulting from actions such as downloading, installing, or utilizing the Platform, or even copying, distributing, or downloading content from it. It’s on you to ensure your data, content, and devices are adequately protected and backed up while using the Platform.

You agree to protect us from any losses that arise if you breach these Terms or if a third party raises a claim against us related to your content. Neither of us will be liable for indirect, punitive, special, incidental, or consequential damages. These might include losses in business, revenue, profits, privacy, data, goodwill, or other economic benefits. This applies whether the issue stems from a contract breach, negligence, or any other cause—even if we were aware of the potential for such damages.

Our liability to you under these Terms or related to the Platform will not go beyond the greater of the fees you paid us in the 12 month period before the liability emerged, or $100.

LinkFast want to make a few important disclaimers within these terms. When you use Platform and explore any content, you’re doing so at your own risk. The Platform is provided to you “AS IS” and “AS AVAILABLE”, without any warranties of any kind, whether they’re express or implied, including (but not limited to), up-time or availability, or any implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
LinkFast and its licensors do not make any express or implied warranties or representations, including that:

- the Platform will function uninterrupted, securely or be available at any time or place;
- any errors or defects will be corrected;
- the Platform is free of viruses or other harmful components;
- the Platform is effective or the results of using the Platform will meet your needs; or
- any content on the Platform (including any user content) is complete, accurate, reliable, suitable or available for any purpose.

These Terms apply to the maximum extent permitted by law and nothing in them is intended to exclude, restrict or modify legal rights that you may have, which cannot be excluded, restricted or modified by contract. If these Terms are governed by the Australian Consumer Law, our liability to you for not complying with a consumer guarantee is limited to re-supply of the services or payment.

13. Third Party Services
LinkFast collaborates with various third parties offering products and services. We may provide access to these features or services offered by third parties within the Platform, such as payment gateways or online stores, social media platforms, and the like. Unless otherwise stated, we do not endorse or guarantee any third-party products or services, and we do not offer refunds for payments made to third parties. The use of products or services provided by third parties may be subject to separate terms and conditions, for which the user is solely responsible for reviewing, accepting, and complying with. Failure to accept or comply with the terms of third parties may result in suspension, termination, or restriction of your account or access to these services on our Platform.
